In a nutshell, the new Act was assented to and signed by the President on the 19 th September 2019. It was published in the Government Gazette No. 42746 on 3 October 2019. It provides for the regulation of property practitioners and provides for the continuation of the Estate Agency Affairs Board as the Property Practitioners Regulatory Authority. It also provides for Consumer Protection, and for the repeal of the Estate Agency Affairs Act of 1976.

Buying a property is probably the biggest investment anybody will make during their lifetime. Consumers are aware of this and need professional advice that can help them make the correct investment decision. Most consumers, both buyers/lessees and sellers/lessors, are not trained to identify structural or patent defects in properties. It is wise to advise consumers to have the property inspected by a certified professional property inspector, such as PPI, to thoroughly and professionally inspect the property and issue an inspection report that can be used as the prescribed mandatory disclosure form contemplated in section 67, Chapter 10 of the Act.

They can, BUT… it must remembered that under the new Act, it is not the seller/lessor that will be held liable by an affected buyer/lessee, but he property practitioner may be held liable for any undisclosed defects that may be discovered within the first 12 months of the conclusion of the property transaction. You need to protect yourself by insisting that a professional property inspection is done by a certified professional property inspector, prior to accepting any mandate.
